Irell Files Amicus Brief in FriedrichsPrint PDF
On September 11, 2015, Irell & Manella LLP filed an amicus brief in the U.S. Supreme Court on behalf of the Friedman Foundation for Educational Choice in Friedrichs v. California Teachers Association. The case will be argued in the Supreme Court this term and addresses whether compulsory public employee union "agency fees" violate the First Amendment of the U.S. Constitution. Schwarz also represents Gerawan Farming in a case involving constitutional issues and labor unions. In May 2015, at the request of Gerawan Farming, the California Court of Appeal struck down as unconstitutional the forced contracting procedures under the California Agricultural Labor Relations Act, holding that this law violated equal protection safeguards under the state and federal constitutions, and unlawfully delegated legislative power. The case is now pending before the California Supreme Court. The matter is Gerawan Farming, Inc. v. Agricultural Labor Relations Board. For more, please see the decision.
