Representative Matters
TiVo Inc. v. EchoStar Communications, Inc. (E.D. Tex.): Represented TiVo, the developer of the first commercially available digital video recorder (DVR) in a patent infringement case against EchoStar. After a two-week trial, the jury unanimously found all of TiVo’s asserted claims to be valid and infringed by all of EchoStar's accused products, and awarded TiVo $74 million in damages. The jury also found, by clear and convincing evidence, that the infringement was willful.
Avago Technologies Ltd. v. PixArt Imaging, Inc. (N.D. Cal.): Represented Avago, the world's largest privately-held semiconductor company, in a patent infringement case involving optical mouse technology. The case settled successfully for Avago.
Avago Technologies Ltd. v. Elan Microelectronics Corp. (N.D. Cal.): Currently representing Avago in a patent infringement case involving optical mouse technology. Avago has accused Elan's CMOS optical mouse navigation sensors of infringing Avago's patents.
Forterra Systems, Inc. v. IMVU, Inc. (N.D. Cal.): Currently representing IMVU in a patent infringement case involving three-dimensional multi-user internet chat technology. The Court has issued a claim construction order substantially adopting all of IMVU's proposed claim constructions. The litigation has been stayed pending an Inter Partes Reexamination filed on behalf of IMVU, where the Patent Office recently issued a non-final Office Action invalidating all of Forterra's patent claims asserted in the litigation.
