Jared  Gale

Jared Gale is an associate in the Newport Beach office of Irell & Manella LLP, where he is a member of the litigation workgroup.

Mr. Gale has represented plaintiffs and defendants at both the trial and appellate levels, and in state and federal courts throughout the United States.  He has an array of litigation experience, including all phases of discovery, law and motion practice, oral argument, mediation, arbitration, trial, and settlement negotiation.

In 2009, Mr. Gale was selected for inclusion in Los Angeles Magazine's list of Southern California "Rising Stars" in business litigation. He is a member of the State Bar of California.

While at law school, Mr. Gale served as an Assistant District Attorney in the Massachusetts District Court of Eastern Norfolk (known as the Quincy District Court) where he had the opportunity to serve as lead prosecutor on multiple criminal cases and to first-chair multiple criminal trials.  Mr. Gale also served as a member of the Harvard Defenders where he provided free representation to low-income criminal defendants in show-cause hearings before Clerk-Magistrates of the Massachusetts Trial Court.

Representative Matters:

  • Mr. Gale represents William I. Koch in litigation related to counterfeit wine in courts across the country, including the United States District Court for the Southern District of New York and state courts in California, Illinois, and New York.
  • Edward M. Wolkowitz, as Trustee for Imperial Credit Industries, Inc. v. Perry A. Lerner, Santa Monica Pictures, LLC, and Corona Film Finance Fund, LLC (C.D. Cal.).  Mr. Gale recently served as second-chair trial counsel for a bankruptcy trustee suing a former director of the bankrupt company and that director's affiliated companies.  The trustee alleged that the former director breached his fiduciary duties to the company by selling an unfair and unreasonable tax shelter to his company.  The trustee sought to void the tax shelter and obtain repayment of all money paid for the tax shelter, plus prejudgment interest.  After a ten day trial, the trustee prevailed on all claims.  The tax shelter transaction was voided, and the defendants were ordered to return all money paid in the transaction plus prejudgment interest for over a decade, totaling $27 million.  Mr. Gale played a fundamental role in all aspects of the trial, including argument, direct and cross examinations, and all related briefing.
  • Mr. Gale recently served as second-chair trial counsel for a medical device manufacturer in a confidential AAA arbitration involving a dispute over termination of a foreign distributor agreement.  The foreign distributor sought over $80 million in damages from an admitted breach of contract and related claims.  After successfully bifurcating the arbitration hearings, the manufacturer prevailed in proving that the agreement had been properly terminated, thereby reducing the damages sought by over 75%.  In the second phase, which focused on damages, the arbitrator denied the majority of the distributor's claims, and awarded damages of only approximately 3% of the amount the defendant claimed for plaintiff's admitted breach.  No challenge to the arbitration award was ever made.  Mr. Gale was intimately involved in all aspects of the hearings, including argument, direct and cross examinations, and all related briefing.
  • Successfully represented apartment management companies in multiple California state court class action lawsuits regarding potential application of California statute regulating "investigative" reports, including novel class certification issues.
  • Successfully represented client in obtaining dismissal of class claims in a putative wage and hour class action, resulting in a very favorable settlement.
  • Successfully represented client in obtaining a refund, including a stock purchase warrant, of its hedge fund investment in an oil and gas start-up company.

Other Interests

Mr. Gale has also volunteered as a coach of a high school team in the Constitutional Rights Foundation Orange County mock trial competition.  He enjoys all sports, especially golf and basketball, and spending time with his family.
