Recent MatterIrell Scores Patent Victory Against SiriusXM
On September 7, 2021, an Irell & Manella LLP team secured a major win for client Fraunhofer-Gesellschaft in its disputes against SiriusXM. The firm persuaded the U.S. Court of Appeals for the Federal Circuit to affirm a Patent Trial and Appeal Board ruling upholding the validity of a fundamental patent on satellite radio technology that Fraunhofer has asserted against SiriusXM. This is the second Federal Circuit win Irell has secured for Fraunhofer within the past two years in litigation against SiriusXM. In October 2019, Irell also convinced the Federal Circuit to revive Fraunhofer’s infringement litigation against SiriusXM in the U.S. District Court for the District of Delaware after a judge dismissed the suit.
David McPhie argued before the Federal Circuit on both occasions, and the teams also included Ben Yorks and Kamran Vakili.
