Irell Secures Federal Circuit Victory for PopSockets

Irell secured a Federal Circuit victory for client PopSockets in a variety of suits brought by Flygrip accusing PopSockets products of infringement. The products Flygrip accused of infringement included, among other products, PopSockets’ entire line of PopGrip smartphone grips, which PopSockets has sold nearly 300 million of to date.

In 2021, Flygrip filed two suits in the Western District of Texas accusing PopSockets products of infringement: Flygrip, Inc. v. Walmart Inc., 6:21-cv-01082 (W.D. Tex.), and Flygrip, Inc. v. Amazon.com, Inc., 6:21-cv-01081 (W.D. Tex.). PopSockets subsequently filed a complaint against Flygrip in the District of Colorado. The Patent Trial and Appeal Board found all challenged claims unpatentable in two IPRs filed by PopSockets and the Federal Circuit affirmed those decisions, which covered all patent claims Flygrip had asserted against PopSockets products.
